FEDERAL CIRCUIT ISSUES FAVORABLE DECISION FOR FIRM'S CLIENT IN TRUSTEES OF BOSTON UNIVERSITY V. EVERLIGHT ELECTRONICS

On July 25, 2018, the Federal Circuit issued a favorable decision for the firm’s clients in Trustees of Boston University v. Everlight Electronics, Co.  Kevin Russell argued in support of the Appellees, with Charles Davis assisting with the briefing.  The U.S. District Court for the District of Massachusetts upheld a $12 million jury verdict against the firm’s clients, finding that they infringed Boston University’s patent on semiconductor manufacturing technology and that the patent was not invalid.  In a unanimous, precedential opinion written by Chief Judge Prost, the Federal Circuit reversed the district court, holding that the asserted claim of the patent was invalid as not enabled and vacating the damages award.
