Supreme Court Issues Favorable Decision for Firm’s Client in Controlled Substance Case

On June 18, 2015, the Supreme Court issued a favorable decision for the firm’s client in McFadden v. United States.  Kevin Russell argued for the petitioner.  In an opinion written by Justice Thomas, the Court unanimously held that when a controlled substance is an analogue, the statute requires the government to establish that the defendant knew he was dealing with a substance regulated under the Controlled Substances Act or Analogue Act.  The opinion can be found here.
